Terms of Use
Effective October 26, 2026 (updated October 26: hosting on the web)
These terms are an agreement between you and Avident Solutions, based in Texas, USA ("we", "us", "our"), for your use of the AquiGo app and website (together, "AquiGo"). By creating an account, joining a party or otherwise using AquiGo, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use AquiGo.
The short version
- You must be 13 or older to use AquiGo, and 18 or older to buy a plan.
- You own what you share. Share only what you have the right to, and be kind.
- Hosts run their parties and can remove content and people.
- Plans are one-time purchases for a single party, paid through the App Store or Google Play.
- Photos and videos are deleted when a party's album period ends. Save what you want to keep.
- If something goes wrong, contact us first and we'll try to fix it.
1. Who can use AquiGo
You must be at least 13 years old, or older if the law where you live requires a higher age to use an online service without a parent's permission. If you're under 18 (or the age of majority where you live), a parent or guardian should review these terms with you. You must be at least 18 to buy a plan. You can't use AquiGo if we've previously banned you, or if the law forbids you from using it.
2. Accounts, guests and hosts
- Hosts create an account with an email and password, Google or Apple, in the app or on our website, and can use the same account in both. Give accurate information, keep your sign-in secure, and tell us if you think someone else has used your account. You're responsible for what happens under your account.
- Guests join a party with its code and a display name. You don't need an account, so your access is tied to the device you joined on.
- Hosts are responsible for their parties: who they invite, the games and announcements they create, and how they moderate. A party's code works like an invitation, so share it only with people you want there. Hosts can make guests co-hosts, who help run the party.
- Don't use a name that impersonates someone else or is offensive.
3. Your content
You keep ownership of the photos, videos, messages, profile pictures, game questions and other content you share ("your content"). To run AquiGo, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, resize, display and transmit your content, only to provide and protect AquiGo for you and the people in your party. This license ends when your content is deleted, except for copies we must keep by law or that remain briefly in backups.
Content you share in a party can be seen by its members, who can save and share it. We can't control copies they make.
You promise that you have the rights to everything you share, and that anyone identifiable in your photos and videos is OK with it being shared in the party. Don't share private information about other people.
4. Community rules
AquiGo is for celebrating together. You agree not to use AquiGo to:
- share anything illegal, or that sexualizes, exploits or endangers minors in any way;
- share sexually explicit material, graphic violence or gore;
- harass, bully, threaten, intimidate or stalk anyone, or encourage self-harm;
- promote hate or discrimination based on race, ethnicity, religion, disability, sex, sexual orientation, gender identity or similar characteristics;
- share someone's photo, video or personal information when they've said no, or in a way that violates their privacy;
- infringe anyone's copyright, trademark or other rights;
- spam, scam, impersonate others or mislead people;
- upload viruses or harmful code, or try to hack, overload, scrape or reverse engineer AquiGo, or get around its plan limits, security or the limits on who can see what;
- use AquiGo for anything commercial we haven't agreed to, such as selling or advertising to guests.
5. Reports, moderation and enforcement
Anyone in a party can report photos, videos, profile pictures and people, and block people. Reports go to the party's host and co-hosts, who can hide, restore or delete content and remove guests. You can also report serious problems to us at support@aquigo.app.
We don't review every party, but we may remove content, limit features or suspend or close accounts and parties that break these terms or put people at risk, and we may report illegal content, especially anything involving the exploitation of children, to the authorities. We'll try to tell you when we act, unless doing so would be unsafe or unlawful. If you think we got it wrong, email us and we'll look again.
6. Copyright complaints
We respect intellectual property. If you believe content on AquiGo infringes your copyright, email support@aquigo.app with: your contact details; a description of the work; where the content is (for example, the party code and what it shows); a statement that you believe in good faith the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and that you own or are authorized to act for the owner of the rights; and your physical or electronic signature. We'll remove infringing content and may close the accounts of repeat infringers. If your content was removed and you believe that was a mistake, you can send us a counter-notice with the details the law requires.
7. Plans, payments and refunds
- Free: anyone with an account can host as many Free parties as they like, in the app or in a web browser, each with the limits shown in the app.
- Paid plans (Standard and Celebration) are one-time purchases that upgrade a single party, not subscriptions. Upgrading a Standard party to Celebration costs the difference shown in the app. A plan's features and limits are those shown in the app when you buy it.
- Payment is made in the AquiGo app through the App Store or Google Play at the price shown in the app, including any taxes they charge, and is subject to their terms. Plans can't be bought on the website; a party set up in a browser can be upgraded from the app with the same account. We never see your card details.
- Cancelling before the party's date: if a host cancels a paid party before its date, Google Play purchases are refunded automatically. For App Store purchases, Apple handles refunds; the app will point you to Apple's refund request page.
- After the party's date, or if you delete a party or your account, purchases aren't refundable, except where the law or the store's policy says otherwise.
- Restore purchases: if a purchase didn't reach your party, use Restore purchases in Settings or contact us.
- If a store refunds or reverses a payment, the party may return to the Free plan, and content beyond the Free plan's limits may become unavailable.
- We may change prices and plans for future purchases. Changes don't affect parties already paid for.
8. Albums and deletion
Photos and videos are deleted automatically when a party's album period ends, as described in our Privacy Policy. Cancelled parties are deleted after 7 days, and hosts can delete a party at any time. We can't recover deleted content, so save anything you want to keep. AquiGo isn't a backup or storage service.
9. Our app and your license to use it
AquiGo, including its design, games, text, logos and software, belongs to Avident Solutions and its licensors, and is protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use AquiGo for your own non-commercial use under these terms. You may not copy, sell, rent, modify or create versions of AquiGo, or use our name or logo, without our written permission. If you send us ideas or feedback, we may use them freely.
10. Other services
Some features use other companies' services, such as GIF search from GIPHY, sign-in with Google or Apple, and the app stores. Their content and services are their responsibility and may have their own terms.
11. App stores
If you got AquiGo from Apple's App Store or Google Play, these terms are between you and us, not the store. If you use the iPhone app: Apple has no obligation to provide maintenance or support for it; if the app fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price (if any), and to the maximum extent the law allows Apple has no other warranty obligation; we, not Apple, are responsible for handling claims about the app, including product liability, consumer protection and intellectual property claims; you confirm you're not in a country under a US government embargo or on a US list of prohibited or restricted parties; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also follow the store's own terms of service.
12. Disclaimers
We work hard to keep AquiGo running well, but it's provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise that AquiGo will be uninterrupted, error-free or always available, or that content will never be lost. Content in parties comes from the people in them, not from us, and we're not responsible for it.
13. Limitation of liability
To the fullest extent the law allows, Avident Solutions and its owners, employees and providers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of AquiGo. Our total liability for any claim relating to AquiGo is limited to the greater of the amount you paid us for AquiGo in the 12 months before the claim, or US $50. These limits don't apply where the law doesn't allow them, and nothing in these terms limits rights you have as a consumer that the law says can't be waived.
14. Your responsibility for claims
If someone brings a claim against us because of content you shared or your breaking these terms or the law, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.
15. Ending your use
You can stop using AquiGo at any time. Hosts can delete their account in the app, and guests can leave any party. We may suspend or end your access if you break these terms, if we must by law, or if we stop offering AquiGo; if we stop offering it, we'll try to give reasonable notice so you can save your content. Sections that by their nature should continue after your use ends (including 3, 6, 9 and 12 to 18) continue.
16. Disputes and governing law
Talk to us first. Most problems can be solved quickly. Before starting any legal claim, please email support@aquigo.app with a description of the problem and what you're asking for, and give us 30 days to try to resolve it informally.
Governing law. These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. If we can't resolve a dispute informally, either of us may bring an individual claim in small claims court where it qualifies; otherwise, disputes will be decided exclusively by the state or federal courts located in Texas, and you and we agree to their jurisdiction.
Consumers outside the US. If you live in the UK, the EU or another country whose law gives you the right to bring a claim where you live or to rely on your local consumer protections, nothing in this section takes those rights away.
17. Changes to AquiGo and these terms
AquiGo will change and improve over time, and we may add, change or remove features. We may also update these terms. We'll change the date at the top, and for significant changes we'll tell you in the app or by email at least 14 days before they take effect, unless a change is needed sooner for legal or safety reasons. If you keep using AquiGo after changes take effect, you accept them; if you don't agree, stop using AquiGo and delete your account.
18. General
- These terms and our Privacy Policy are the whole agreement between you and us about AquiGo.
- If any part is found unenforceable, the rest stays in effect, and that part will be applied as far as the law allows.
- If we don't enforce a part of these terms right away, we don't give up our right to do so later.
- You may not transfer your rights under these terms. We may transfer ours, for example as part of a merger or sale of the business.
- We aren't responsible for delays or failures caused by events outside our reasonable control.
- These terms are written in English; if we provide a translation, the English version applies where they differ, unless your local law says otherwise.
